CC issue

Interesting blog I just came across at Harry Chen Thinks Aloud. Seems Virgin are using flickr pictures which were posted with the Creative Commons license but they are of someone whom Virgin did not get permission from. Seems this is illegal in US and Australia (where the campaign is running). Wonder what the situation would be here? Definitely worth taking account of.
